A joint resolution “[d]eclaring that there is need for a housing authority in the City of Richmond” approved October 3, 1940 pursuant to enabling legislation known as the Housing Authorities Law and now codified as Title 36, Chapter 1 of the Code of Virginia (1950). COMPOSITION
Section 5.05(d) of the Charter of the City of Richmond (2006) expressly provides that “the appointment of members of a redevelopment and housing authority in the city shall be made by the council.” Section 36-11 of the Code of Virginia (1950) authorizes the Council to provide for not more than nine or less than five commissioners of the Authority. By Resolution No. 99-R46-80, adopted March 22, 1999, the Council increased the number of commissioners from five to seven as authorized by section 36-11 of the Code of Virginia (1950). As amended by Resolution No. 2010-R140-162, adopted October 25, 2010, the Council increased the number of commissioners from seven to nine. (An additional Council-appointed seat and an additional tenant representative seat.) Pursuant to section 36-11 of the Code of Virginia (1950), no commissioner of the Authority may be an officer or employee of the City. By Resolution No. 2003-R230-2004-R18, adopted January 12, 2004, and amended by Res. No. 2010-R141-173, adopted November 8, 2010, amended by Res. No. 2016-R017, adopted March 28, 2016, and further amended by Res. No. 2016-R057, adopted December 12, 2016, the Council established a procedure to be followed for appointing members living in public or assisted housing to serve on the authority’s Board of Commissioners as required by the regulations of the United States Department of Housing and Urban Development. TERM OF OFFICE
Two members shall be tenant representatives. All members serve four (4) year terms.

OBLIGATION
To exercise the powers and carry out the duties set forth in the Housing Authorities Law now codified as Title 36, Chapter 1 of the Code of Virginia (1950); To study slum and blighted areas within the City and to recommend programs for their improvement, utilizing the assistance of citizens in the development and implementation of plans for their neighborhood; To provide quality housing for low-income families at rents within their ability to pay; and To carry out such other activities as may be necessary to implement programs of housing development, redevelopment and rehabilitation as may be approved by the City Council.
